Respondents represented by CHARLES MCLEMORE, Attorney, Little Rock, Arkansas. OPINION/ORDER This case comes on for review following a hearing on respondent’s Motion to Dismiss. Respondent accepted a compensable injury in the form of carpal tunnel syndrome and paid some medical benefits to claimant. In an order filed August 31, 2020, claimant was granted a change of physician to Dr. Stephen Heim. Claimant was evaluated by Dr. Heim on September 22, 2020. Since that time, claimant has received no additional medical treatment and no further benefits have been requested. As a result, respondent filed a Motion to Dismiss in October 2023. A hearing on respondent’s motion was scheduled for March 25, 2024. Notice of the hearing was sent to claimant by certified mail and delivered on February 28, 2024.

Dumas – G801775 2 Claimant did not appear at the hearing; however, her attorney was present and indicated that he had discussed this claim with the claimant who indicated that she was not interested in any additional surgical treatment and did not object to dismissal of the claim. Accordingly, after my review of the respondent’s motion, the claimant’s response thereto, and all other matters properly before the Commission, I find that respondent’s motion to dismiss this claim should be and hereby is granted.
