STEWART in Fort Smith, \nSebastian County, Arkansas. \n \nClaimant represented by MATTHEW J. KETCHAM, Attorney, Fort Smith, Arkansas. \n \nRespondents represented by CHARLES MCLEMORE, Attorney, Little Rock, Arkansas. \n \n \n \n OPINION/ORDER \n  \n This  case  comes  on for review following a hearing on respondent’s Motion to \nDismiss. \n Respondent accepted a compensable injury in the form of carpal tunnel syndrome \nand paid some medical benefits to claimant.  In an order filed August 31, 2020, claimant \nwas granted a change of physician to Dr. Stephen Heim.  Claimant was evaluated by Dr. \nHeim  on  September  22,  2020.    Since  that  time,  claimant  has  received  no  additional \nmedical treatment and no further benefits have been requested.  As a result, respondent \nfiled  a  Motion  to  Dismiss  in  October  2023.     A  hearing on  respondent’s  motion  was \nscheduled for March 25, 2024.  Notice of the hearing was sent to claimant by certified \nmail and delivered on February 28, 2024. \n\nDumas – G801775 \n \n2 \n \n Claimant  did  not  appear  at  the  hearing; however, her  attorney  was  present  and \nindicated that he had discussed this claim with the claimant who indicated that she was \nnot interested in any additional surgical treatment and did not object to dismissal of the \nclaim. \n Accordingly, after my review of the respondent’s motion, the claimant’s response \nthereto, and all other matters properly before the Commission, I find that respondent’s \nmotion to dismiss this claim should be and hereby is granted.  This dismissal is pursuant \nto Commission Rule 099.13 and it is without prejudice. \n IT IS SO ORDERED. \n \n      _____________________________________ \n       GREGORY K.
