ORDER Presently before the Full Commission is Respondents’ Motion to Stay Appeal and Remand for Consideration of Joint Petition for Final Settlement. Respondents and claimant have reached a proposed settlement agreement of the instant claim and of a companion claim involving the same claimant, and parties intend to submit a Joint Petition for final Settlement of both claims to an Administrative Law Judge for consideration. Accordingly, the respondents, without objection from claimant, request that its pending appeal to the full commission in this claim be stayed.
Sandoval-H302270 2 Respondents further request, without objection from Claimant, that the instant appeal of this claim would resume should the Joint Petition not be approved, giving parties sufficient time to resume the briefing schedule from that point. After consideration of respondents’ motion with no objections by the claimant and all other matters properly before the Commission, we find that the respondents’ motion should be granted. Therefore, the appeal of the Administrative Law Judge’s Opinion filed January 3, 2024, is stayed pending approval of a joint petition to be presented to an Administrative Law Judge for approval. Should the joint petition not be granted, the appeal of this claim shall resume, and a new briefing schedule be issued.
