ORDER Presently before the Full Commission is Respondents’ Motion to Dismiss Claimant’s Appeal of an administrative law judge’s opinion dated May 14, 2024 due to untimely filing of the Notice of Appeal. Ark. Code Ann. § 11-9-711(a)(1) states: A compensation order or award of an administrative law judge or a single commissioner shall become final unless a party to the dispute shall, within thirty (30) days from the receipt by him or her of the order or award, petition in writing for a review by the full commission of the order or award. (emphasis added).

Daniels – H000613 2 The Claimant received the issued Opinion on May 24, 2024, according to the signed USPS green card, which would make the notice of appeal due on June 23, 2024. Since June 23, 2024, fell on Sunday, the Claimant’s notice of appeal was not due until Monday, June 24, 2024. The Claimant emailed the notice of appeal to the Commission on June 26, 2024. After consideration of Respondents’ motion and all other matters properly before the Commission, we find that the Respondents’ Motion to Dismiss Claimant’s Appeal should be and is hereby granted.
