OPINION/ORDER This case comes on for review following a hearing on respondent’s Motion to Dismiss. On May 9, 2024, claimant filed Form AR-C alleging an injury to his right shoulder, right elbow, and other parts of his body. Respondent accepted the claim as compensable and paid some compensation benefits. Thereafter, on April 30, 2024, Attorney Laura Beth York’s Motion to Withdraw as Counsel was granted by the Full Commission. Since that time, claimant has not corresponded with the Commission or taken any action to prosecute his claim. On September 6, 2024, respondent filed a motion to dismiss this claim for failure to prosecute. A hearing was scheduled on the respondent’s motion for October 30, 2024 and notice of that hearing was sent to claimant by certified mail. The notice was delivered

Chaisson – H304357 2 to the claimant on October 4, 2024. Claimant has not responded to the respondent’s motion and did not appear at the hearing. After my review of the respondent’s motion, the claimant’s failure to respond thereto, and all other matters properly before the Commission, I find that respondent’s Motion to Dismiss should be and hereby is granted.
