STATEMENT OF THE CASE This case comes on for review following a hearing on respondent’s Motion to Dismiss. Claimant suffered an injury which respondent accepted as compensable on November 28, 2022. On December 7, 2022, Form AR-C was filed on claimant’s behalf by his attorney, Jarid Kinder. There has been no activity since the AR-C filing and as a result, respondent filed this Motion to Dismiss on May 30, 2025. A hearing was scheduled on the respondent’s Motion to Dismiss for July 14, 2025, and notice of the hearing was sent to claimant by certified mail and delivered on June 14, 2025. On June 9, 2025, an email was sent by claimant’s attorney indicating that claimant had no
Jackson – H208517 -2- objection to the Motion to Dismiss and that he waived his appearance at the hearing. As a result, neither claimant nor his attorney appeared at the hearing. After my review of respondent’s motion, claimant’s statement that he has no objection to the granting of the motion, and all other matters properly before the Commission, I find that respondent’s Motion to Dismiss should be and hereby is granted.
