OPINION/ORDER This case comes on for review following a hearing on respondent’s Motion to Dismiss. Claimant suffered a compensable injury to her right ankle on October 26, 2021. This injury was accepted by respondent as compensable and medical benefits were paid. On February 1, 2022, claimant filed Form AR-C requesting various compensation benefits. Despite filing the AR-C, no further action was taken by claimant to pursue her claim. On December 7, 2022, respondent requested dismissal of the claim. Following the respondent’s request, claimant completed Commission interrogatories agreeing to dismissal of the claim, but did not have them notarized despite being given additional time to do so.

Grisham – H200996 2 Consequently, a hearing was scheduled for respondent’s Motion to Dismiss for February 27, 2023. Notice of the hearing was sent to claimant by certified mail and was returned as “Unclaimed.” Claimant did not appear at the hearing and has made no further response to the respondent’s request. After my review of the respondent’s motion, the claimant’s response thereto, and all other matters properly before the Commission, I find that respondent’s motion to dismiss this claim should be and hereby is granted.
