Caldwell,  Attorney  at  Law,  Little  Rock \nArkansas.    \n \nThe Respondents were represented by the Honorable Melissa Wood, Attorney at Law, Little Rock, \nArkansas. \n   \nNUNC PRO TUNC ORDER  \n \nThe  parties  have  jointly  asked  the  undersigned  to  amend  the  Stipulations  portion  of  my \nOpinion filed in the above-referenced claim on June 29, 2023.  Therefore, pursuant to Ark Code \nAnn. §11-9-713(d) (Repl. 2012) said Opinion is hereby amended to add the stipulation described \nbelow.   \nSpecifically,  at  the  hearing,  the  Respondents  withdrew  their  contention  regarding  the \nClaimant’s widow not being “wholly and actually” dependent upon the Claimant at the time his \ndeath.  In light of that, the parties asked in an e-mail on July 17, 2023 that I modify the Opinion to  \nadd  the  following  stipulation: “In  the  event the  Commission’s  finds  that  the  Claimant  was \nperforming employment services at the time of his death, the widow was “wholly and actually” \ndependent  upon  him  at  all  relevant  times  and  entitled  to  benefits  at  the  stipulated  amount  of \n$547.00 per week.”   \n\nWilliams – H207041 \n \n \nTherefore, said Opinion is hereby modified solely to reflect this additional stipulation.
